Welcome to Lucky Moi. These Terms of Service ("Terms") govern your access to and use of the Lucky Moi mobile application ("App," "Service," or "Lucky Moi"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Lucky Moi, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility

You must meet the following requirements to use Lucky Moi:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable law
• You have not previously been suspended or banned from Lucky Moi

3. Account Registration

3.1 Account Creation

To use Lucky Moi, you must create an account by providing:

• A unique username
• A valid email address
• Responses to 27 onboarding questions about yourself

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary. Providing false information may result in account termination.

4. Partner Connection

4.1 Finding Your Partner

Lucky Moi is designed for couples in committed relationships. You may search for and connect with one partner using their username.

4.2 Connection Requirements

• You may only be connected to one partner at a time
• Both partners must accept the connection request
• Both partners must have active accounts
• You may disconnect and connect with a different partner, but this will reset certain features

4.3 Shared Data

When connected with a partner, certain information becomes mutually visible as described in our Privacy Policy. You control what weekly check-in content is shared with your partner.

5. Subscription and Payment

5.1 Free Trial

New users receive a 16-day free trial of Lucky Moi Premium. The free trial includes:

• Full access to all premium features
• No charges during the trial period
• Ability to cancel anytime without charge

5.2 Premium Subscription

After the free trial, continued access requires a Premium subscription:

• Price: $19.99/month per person
• Billing: Automatically charged to your Apple ID account
• Both Partners Required: Both partners must maintain active subscriptions to use the app
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the current period ends

5.3 Payment Processing

All payments are processed through Apple's In-App Purchase system. Your subscription is subject to Apple's App Store Terms of Service.

5.4 Cancellation and Refunds

• Cancel Anytime: You may cancel your subscription at any time through your Apple ID account settings
• Access Until Period Ends: Cancellation takes effect at the end of your current billing period
• No Partial Refunds: We do not provide refunds for partial months or unused portions of your subscription
• Trial Cancellation: Cancel during the free trial to avoid being charged

For refund requests, contact Apple Support directly. We cannot process refunds for App Store purchases.

5.5 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current subscription period.

6. Acceptable Use

6.1 Permitted Use

You may use Lucky Moi only for its intended purpose: enhancing your committed romantic relationship through reflection, games, challenges, and personalized insights.

6.2 Prohibited Conduct

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, threaten, or harm your partner or any other user
• Share content that is hateful, violent, sexually explicit, or otherwise inappropriate
• Impersonate any person or entity
• Upload malware, viruses, or any harmful code
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble the App
• Use the Service for commercial purposes without our permission
• Create multiple accounts or share your account with others
• Scrape, mine, or extract data from the Service using automated means
• Interfere with or disrupt the Service or servers

6.3 Content Standards

When using messaging features or sharing check-in responses, you agree:

• Your content will be respectful and appropriate
• You will not share content you don't have the right to share
• You are solely responsible for your content

7. Intellectual Property

7.1 Our Rights

Lucky Moi and all its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. This includes:

• The Lucky Moi name, logo, and branding
• The app design, interface, and user experience
• Daily inspirational quotes
• AI-generated questions and challenges (structure and methodology)
• All source code and software

7.2 Your Rights

You retain all rights to the content you create, including:

• Your profile information
• Your weekly check-in responses
• Messages you send to your partner

7.3 License to Us

By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

• Store and process your content to provide the Service
• Use your content to generate personalized AI-powered features
• Display your content to your connected partner as you've authorized

This license terminates when you delete your content or account.

8. AI-Generated Content

8.1 How AI Works in Lucky Moi

We use Anthropic's Claude AI to generate:

• Personalized multiple-choice questions about your partner
• Weekly relationship challenges tailored to your profiles
• Gift suggestions based on your partner's interests
• Date ideas and detailed itineraries

8.2 AI Content Disclaimer

AI-generated content is provided for entertainment and relationship enhancement purposes only:

• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content
• AI suggestions should not replace professional relationship counseling or therapy
• You are responsible for evaluating whether AI suggestions are appropriate for your relationship
• We are not liable for any outcomes resulting from following AI-generated suggestions

9. Termination

9.1 Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion:

• Your subscription will be canceled (subject to Apple's policies)
• Your data will be deleted as described in our Privacy Policy
• You will lose access to all premium features immediately

9.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to Lucky Moi at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended non-payment or subscription issues
• Any reason we deem necessary to protect the Service or other users

9.3 Effect of Termination

Upon termination by either party:

• Your right to use the Service immediately ceases
• We may delete your account and data
• No refunds will be provided for unused subscription time (unless required by law)
• Sections of these Terms that by their nature should survive (disclaimers, limitations of liability, etc.) will continue to apply

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

LUCKY MOI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of AI-generated content

10.2 Not Professional Advice

Lucky Moi is not a substitute for professional relationship counseling, therapy, or medical advice. The Service is for entertainment and relationship enhancement purposes only.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUCKY MOI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or technical failures
• Outcomes resulting from AI-generated suggestions or relationship advice
• Any damages arising from your relationship with your partner

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

10.4 Third-Party Services

We are not responsible for the privacy practices or content of third-party services we integrate with (Apple, Firebase, Anthropic). Your use of those services is subject to their own terms and policies.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lucky Moi, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you submit or share through the Service

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12.2 Arbitration Agreement

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that:

• You may assert claims in small claims court if they qualify
• Either party may seek injunctive or equitable relief in court

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• We will notify you through the app or by email for material changes
• Continued use of the Service after changes constitutes acceptance

If you do not agree to modified Terms, you must stop using the Service and delete your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and Lucky Moi regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

For users who download Lucky Moi from the Apple App Store:

• These Terms are between you and Lucky Moi, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with all applicable third-party terms when using the App
